From the photograph, it seems that kid just might have a bit of a problem if he was running around a street in Victoria waving that thing.The defining characteristics of toy firearms are:
they are solely manufactured and used for the purpose of being used as a plaything or for providing amusement; and
their method of operation (if applicable) falls outside of the definition of a firearm in the Firearms Act 1996; and
they have a resemblance to a firearm however their appearance cannot be mistaken for a working firearm by a reasonable person due to the presence of at least one of the following appearance characteristics:
Their shape & size is of a kind not associated with a working firearm;
The barrel and/or butt is of a colour not normally associated with a working firearm, particularly if it is of a bright or fluorescent colour or multi-coloured; and/or
Its composition suggests it is clearly manufactured using material of a kind not associated with a working firearm such as wood or transparent plastic.
Note: From 1 July 2011, devices that have the presence of a coloured barrel plug will be deemed to be an imitation firearm (and not a toy firearm) unless that barrel plug is combined with other characteristics of a toy as described above. This will mean they will require an Approval of the Chief Commissioner or Exemption under the Control of Weapons Act to be possessed, carried, used or sold in the State of Victoria.

That kid looks like a member of a "minority" group to me, He shouldn't be targeted with a ban on his favourite toy. [/sarcasm] Those "imitation" guns may not look like the real thing to an expert, but they certainly look real enough to me. And you wonder why Americans shoot first.

Seriously... it's supposed to be traditional dance... no place for toys.
And you would be absolutely certain that it was a water pistol if it was pointed at you in the middle of the night? (with the red barrel plug removed)
From the detail available in the photograph it appears to be what the police classify as an imitation firearm.
There are examples illustrated in this Vic Police quick guide:
You will notice, from the examples illustrated, that there are significant visual differences between an imitation firearm and a toy firearm.
The NT Police have the same category (imitation firearm) listed in their schedule of Prohibited Weapons (Item 30):
You might be happy that it's a water pistol, but how about some 18 year old kid working as an attendant at a service station or a late night supermarket?

I am aware of the legislation, thanks, but I still fail to see the issue...probably because there isn't one, it's a pic of a kid with a toy.
How about the pedestrians walking down the street if there's a drunk driver behind the wheel of a car?

Kids have played with toy guns for a very long time.
