    It sounds to me like the Judge was amusing himself at Foxtel's expense. The section of the Act is clear, and there is virtually no doubt that Foxtel will get what they are asking for. Foxtel's counsel know this, the judge knows this. But the Judge brought up the issue of the futility of doing this. There is an old equitable maxim, "Equity does not act in vain", which used to mean that an injunction would not be granted if its application would be futile. It has IMHO been vastly watered down and probably has no room to apply here because of the very specific statutory provision. But in different circumstances it could be of real concern. I would be surprised if Foxtel's counsel did not feel a twinge and think oh, no. He's not going to go this way, is he? He was not, of course, but perhaps that little twinge of doubt came up for just a moment. As I said, I think the Judge was just having a bit of fun.
