Ben Batterham fronted Newcastle Supreme Court yesterday.
It will be interesting to see the outcome.
For those who don't know anything about Ben Batterham there's a thread here...

yeah i remember that now , and i hope the homeowner gets off all charges.
if that drug addict criminal coon was stupid enough to break into a house while carrying 3 knives then he got what was coming to him.

Good to see an unbiased opinion hahahaha...
Umm, Doesn't that mean the Fker was going to die anyway??The court was told Mr Slater-Dickson was obese, with a pre-existing heart condition, and a lethal amount of the drug ice in his system.
Given time, with a Lethal amount of drugs in his system would he have not done the decent thing and keeled over from an overdose? Maybe that's what the struggle just brought on or was the cause of him dieing just at that time??
4-6 weeks wasted over a scumbag like this? No wonder the courts are backed up!The trial is expected to last between four and six weeks.
The only reason there should be formal proceedings in this matter is to determine what medal the home owner should be given & to determine how much compensation the scumbags estate should be paying to the homeowner
Estate?
Wouldn't be fair to pass on the deadbeats debts to the home owner which would be about all the estate he had.
Wouldn't be doing break-ins if he had a Job and anything to his name.
They always have money for Drugs, Tattoos and booze though.
I'll guarantee the entire family wouldn't have enough assets to buy a meal at an expensive restaurant.
The gubbermint is now saving one Dole payout, they could now award that to the home owner as compensation. They would be getting a damn site better value for money that's for sure!
Whilst I do agree with the sentiments above, the law is the law and must be seen to be obeyed. Batterham acted in self defence and detained an "alleged" criminal who died while in his custody. Had Batteram been a cop and the crim a 12 YO kid..... you get the picture.
I'm out of my mind, but feel free to leave a message...
I don't think self defence is chasing the offender 300 meters down the road.

I cant see him getting convicted.
Yes he chased him.....he is entitled to hold him given evidence of a serious crime. He has been kicked and bitten by the offender, who was pretty big and iced to the eyeballs. The offender had so many health problems as well as an ice addiction and was obese that he was likely to die of those health issues in a serious fight.
I also read today that when urged to loosen his grip by bystanders, Batterham did and was promptly bitten. Interesting an off duty cop was one of the bystanders......obviously not keen to clock on and take control.

He was attempting to perform a citizen's arrest and was attacked in the process, that, in my book, is self defence.

Lesson to be learned from the story:
Homeowners need to get hold of some real strong Crack. If some POS breaks into your home, Give it to them.
Next day lowlife POS will be found dead down the road from an overdose and you won't have to chase them or have anything to do with the retarded legal system while still getting due Justice for yourself and the shitbag.
Once again there is a real simple lesson in this for the scumbags although they will continue to be too damn stupid to take heed:
If you don't want to be killed by someone protecting their loved ones or property, don't commit crimes in the first place.
the only winners here are the community and centrelink.
Relevant to this thread re self defense in AU............as in we have no rights whatsoever to defend ourselves

This article says what we already knew.
The invader could've died for many reasons not least of which because he had shit in his veins.

Yup, finally some justice done right
If u want to go on an expedition get a Land Rover, if u want to come home from an expedition get a Landcruiser!

"He (Justice Fagan) said Mr Batterham was permitted by law to use reasonable force to detain someone who had committed an offence and stop them from escaping until police arrived.
Justice Fagan said Mr Batterham would be not guilty if he believed he was defending himself from being bitten and attacked."
If Australia is a democracy why, then, is voting compulsory?
"What has changed between the arrival of the First Fleet and today?"
"Wearing leg irons is now not required."
Not a surprising verdict in my opinion, but good to see it anyway.
