I Purchased a clinical blood pressure machine from an Australian medical supplier, this machine was Shipped via Star Track. The service paid for was Premium next day delivery. item sent on Tuesday. Come Thursday the package shows Sydney airport. (i know .... again) this time I think ok thats fine let it be it will come eventually. Yesterday i see still no activity, so i have contacted Star Trak. they have said "yes we scanned this item with the xray machine and found it contains a battery. there was no dangerous goods declaration provided so this item has not been put on the plane." I then asked what the action required at this point is. and they said that its being returned to sender.
So i have gone to the eBay community looking for what happens in this case. what i find is loads and loads of sellers scheming and conniving about how "if it is returned to sender the buyer forfeits their guarantee and they don't have to refund it"
Now Australia Post have made it clear that this is the senders fault.
So I guess going by what the track record is for ebay in this regard with RTS and the fact that although eBay is not Australian, the medical supplier absolutely is and has an ABN do i have an option to take the company itself through consumer mediation? keeping in mind this purchase was for a new product and not a used product and it was bought and sold entirely within Australian borders?

I would suggest that this is not the first item that they have had returned because of "battery". They should be well aware of that situation. Given that this is all Australian, apart from the retailer (eBay) transaction. Consumer affairs might also be able to assist.
I'm out of my mind, but feel free to leave a message...
if you got it from ebay and not receieved all you do is put in a claim through
ebay as not received and then you get all your payment back.
i have had a few instances were i had issues in the past and always got a full refund.
