Is this a remote problem? or something more?
Dont have any other remotes to test it with.
Any ideas?

When you do things right, people won't be sure that you have done anything at all
That used to happen to me all the time on Gemini 3.6, even with new energizer batteries. Recently switched to PLI Iolite, and haven't noticed it once.. in fact, your post reminded me of how annoying it used to be. fwiw, same batteries in the remote before and after change over.
This used to happen to me all the time but I took the cover off the infrared light on the box and it rarely happens now
I have gemini on a 500 in my bedroom and it happens reguarly.
I have found that if the remote is pointed at a particular angle ( in my case down to up ) it does it , but if I raise the remote with arm so its in line it doesnt.
Its possibly a gemini only issue as I remember an old post about it. As has been mentioned , taking the infrared cover off the box will improve range and possibly the problem.
same thing happened to me ..
I had a remote extender to send bedrom to "equipment room"
if things didnt quite line up - then mute would happen
my technical guesstimate is that mute is a simple subset of many other remote commands - therefore if half a command gets through - its the bleeding mute one - rings true for flat battery as well
if I get a chance my trusty old JP1 software would verify that
It's just the crappy chinese remotes, pull them apart and clean them.
Or buy a new one.
not just crappy clones and remotes
mine are both original dm7000 and 5620
see my post above - half a signal getting through
IMHO
actually urban is using a Pli image so its not gemini related.. most likely a remote problem
oh man! my bad on the earlier post thinking gemini 3.6 was the culprit. i just remembered i put pli on my second box in case i couldn't get it up and running (and could fall back on box1).. wound up liking pli and stuck with it on the second clone (which became my primary box).. so in fact, it is a diff box.. same remote tho. doh!
I've had this problem on a couple of DM500's now.
Pull the decoder apart and move the IR sensor up into the window, they don't line up with the window from the factory. The remotes work great after this.
