At the end the day he has a genuine key but its not legit.

1 of my so called friends brings over his lappy 12 months after i removed the stock vista and put xp on it
his been having wireless router problems so he said and took it to 1 of the local pc shops.
the it "pro" lol said it had a non genuine copy of xp on it and that was the problem.
so he put a copy of xp home on it, stuck a second hand coa sticker on the back and charged him $150
the guy noticed the cd he took out was a burnt one and he didnt supply him with any disk.
so is it legit to resell a used copy of xp? coa or not
the serial matches on the pc and sticker?
how did he activate it?
or if its a new cd, where is it?

thats seriously dodgy. no he cant resell windows. and if he sells you a copy even oem i think he has to supply you with a disk. thats seriously illegal, he probably hasnt sold it to anyone else if he still had the sticker lying around but it could be a shop copy or taken it off another machine that he was working on. eitherway its pretty illegal and i wouldnt take that crap.
Technically (and legally) OEM applies to the installation of the software once, on one machine.
You are permitted to re-install the software on the same machine due to corruption of the OS, but not to install it on any other machine.
The 'licence' is not transferrable.
In this case, the installation performed should have been a brand new copy of XP home, using the genuine disk.
From your description, it sounds like the COA has been peeled of another machine and copied software loaded, using the COA key.
It's possible the COA/software was the 'retail' version, not OEM.
This reminds me of a conversation with a computer store earlier this week... mentioning a couple raids by Microsoft/police on computer stores in Melbourne recently.. for doing exactly this type of thing.
