this is a weird 1
i have a au domain i bought 1 night (probably pissed)
it doesnt mean anything to me, but i looked at the site, it had a crappy hosting\domain ads type of site on it (all junk)
so i assumed it lapsed, they buy it & try to sell it back at some ridiculous price, good luck i said
so i looked up the domain, its still current? my nameservers are on it
so i looked in my hosting, its not even setup
how the hell does that work?

I'm not quite understanding your original post. But generally speaking, depending on where you purchased the domain name from, it is not uncommon for the registrar to put a "parked" page there in the interim, that happens to contain ads on it. They are basically making money off of your page via ad revenue until you get some actual content up on the site. Some of them will haven an option to turn off this parked page if you choose. You may want to go digging around in your control panel to see what they offer.
On a similar subject, some web hosts and registrars will also inject ads onto your 404 pages, unless you create your own custom 404 page. I noticed this happening on a site I have hosted with Fatcow.com. For a long time, I thought that my site had been hacked. It turns out this was something Fatcow themselves were doing, and the option to turn it on or off was hidden away within their CPanel.
All that said, it is still possible for hackers to inject ads into your site through a variety of exploits. You are even more prone to this if you are running a Wordpress site and using a pirated commercial theme. Often times the people sharing these pirated themes will insert some of their own ad code into them.
