The fact that there's a highway to hell and a stairway to heaven says a lot about the anticipated traffic flow.

Earlier in the thread I posted a link to the actual judgement and some relevant quotes. I fail to see how the DBC proposal as reported addresses any of the concerns of the Court in any way whatsoever. Having read the original judgement my opinion is that his Honour is well on top of the matter. DBC's lawyers will of course act on their instructions, a task made much easier if they are being well paid. But I would be most surprised if they meet with any success.

I do not understand what they think they can get. It is at best a $2.00 hire from the Video Store.
Good business model they have ie. Spend millions to charge people $2.00 for watching a bad movie.
Maybe the people who watched it should sue the makers for insulting them by making such rubbish.
A blockbuster it is not.

What they are trying to do is to get other countries to adopt the ridiculous US system. Their DMCA sets out statutory damages for copyright infringement at a very high level. So when they sue you, they don't have to prove they have lost anything. They only need to show the number of times you have infringed.

In the United States, statutory damages are set out in 17 U.S.C. § 504 of the U.S. Code. The basic level of damages is between $750 and $30,000 per work, at the discretion of the court.
Plaintiffs who can show willful infringement may be entitled to damages up to $150,000 per work.[1] Defendants who can show that they were "not aware and had no reason to believe" they were infringing copyright may have the damages reduced to $200 per work.[1]
The problem Dallas Buyer's club had in Australia was because we do not have statutory damages. This meant that they would have to prove the amount they actually lost under our law in any case they brought before the Courts. However, the damages they would be entitled to recover under our law are quite limited, and would not be too scary as a threat in their speculative invoicing letters. So, when his Honour took an interest in the demands they were planning to make in such letters, they used a bit of fancy footwork and included heads of damage they were simply most unlikely to get under our law. His Honour, of course, saw through this.
If the TPP results in the inclusion of statutory damages in our Copyright Act, we will be in the same ridiculous position as in the US. If your kids download some music or your system is hacked and used to download copyright material, you will face potential ruin in the Courts. And, of course, be very vulnerable to blackmail by any of the rights holders who may be prepared to take thousands or tens of thousands for you to avoid possible ruin in the Courts. Once the TPP is ratified, which I hope against hope that it will not be, we will then see to just what extent our sad excuses for governments (either Labor or Liberal) and politicians decide to betray us.

All eyes now turn to next week when Perram will decide whether DBC will be allowed to access the details of 10% of the original 4,726 subscribers and if the company will be given permission to appeal the earlier decision to limit claims for damages.
It’s not over yet but DBC still has its eyes glued to the big prize – thousands of dollars in settlements from thousands of Aussie Internet subscribers. And, if they’re successful, more of the same in future.

Dallas Buyers Club dismissed from Federal Court
Woo Hoo .....The Australian Federal Court has dismissed DBC's attempts to claim damages from the 5,000 people who downloaded the movie, with the case to be thrown out unless DBC makes an application by mid February.

Now they have to pay costs. All because they tried to raid the bank accounts of Australian citizens in an attempt to increase the revenue of a really shit movie. At least is was IMO. I didn't last long, so most of it is a mystery to me.
